Well let me explain it to you as you seem to be having problems.
I'll go slow just for you.

Media with DRM requires a player that can work with the DRM in the media. You can NOT allow anyone access to the code or it beomes useless. GPL-3 is trying to block such applications and certainly from being in the open source stack. (That is what Perens is crying a river over and the reason Linus T. said NO THANKS.)

Now I so suppose it could be done by taking everything out of the stack and making every bit of code proprietary but then, open source it's not.

To further complicate it, DRM is being tied to the hardware and unless the OS can address the hardware to meet the needs of the DRM application without revealing how its done then it can't work on the machine.

Linus T. understands this and it is why he has said it must be part of the kernel.

There, that wasn't so hard now was it?
