No it's not!
There are services that exist and many of them that offer this already on the PC. What your talking about is pirating the games and yeah that's illegal same as pirating music, movies and other software.

The big difference here is Microsoft is offering this for the console. Smart move. A step farther than Nintendo that is offering thier older games on thier new console.
