Why don't you pose this question to IBM itself. Unless there is an IBM'er that frequents these forums and can answer that you are really just blowing wind.

Other than that, you probably completely misunderstand Linux. There has never been an absolute expectation that all code available for Linux would be Open Source or some sort of GPL.
