Future Conduct
In a court of law or a body that tries to act as the same, they can not take into account what someone might possibly do in the future. They can of course judge what someone has done, if they have been found guilty and they can of course take into account what was done in the past but they is all they can do. They can not find someone guilty for something that hasn't happened yet.

In this case even though the EU commission has said that Microsoft has done something wrong, they still are not a court of law. Microsoft still has the option of going to a court. How far they would get and if it would make any difference is anyones guess, but they still have that option.

The EU and its commissions could be the greatest thing to ever happen to Europe or it could be the worse, depending on how it operates and how equally everyone is treated. From what I have read about it, it appears to be heading down the worse path but there is always hope that it will turn out right.
