Past infractions are always used as a basis of judgment towards a defendant's future actions. If a rapist gets out and rapes another and gets caught, of course his prior conviction will be taken into account with respect to how he is dealt with in the future. That's just common sense Bit. You'll learn about this when you take law class your senior year. Besides, we just bombed a country based on what they "might" do in the future, so I don't see why the concept can't be used for something that is obviously less of a crime than mass murder.
