Both MS (Ballmer) and EU told the media that while they had agreed on the terms of how to deal with the current issues the EU has, they dissagreed (or better could not agree) on the priciples of how to resolve future disputes that might arise.

So, technically, they did agree onhow to settle the current EU issues.
