The home user who sends spam from a zombied machine. There is a reason why you buy a residential connection - to do personal stuff. Then why don't the ISP's block - say - message 1 million. Once the zombied machine sends its 1 millionth message, then it is blocked from sending more

The small business who sends spam from a zombied machine. The small business, who has any goal of succeeding through the use of a computer needs a security specialist. At the minimum, they should have a $20 internet router that could potentially block becoming a zombie.

The lawmakers. Are we going to throw 86 year old grannies in jail because they got an email from their 10 year old grandson that was actually a virus? Furthermore, any legitimate spam work has just been offshored at this point - since US law doesn't go too far out of the US.
