Not sure what you mean by this or where you are getting your facts... but I don't see them both as 'working together'.

In relation to the subject, I think that severe punishment is justifiable if any person is caught, which they infected any one innocent pc for any reason. The number of spam sent -vs- illegally controlling a innocent pc should be considered different cases. Fine them good for number of messages, but infecting innocent pc's should be considered highly serious with possible jail time. To me, I personally feel that hi-jacking an innocent pc (trojan, virii, malware) is as serious as hi-jacking anything else.

The lawmakers, courts and govt are looking at them as one and the same.

Lawmakers and courts have been dealing with these issues for years and they still are playing the "I don't understand the Internet" attitude. They need professional IT advice, not attorneys who consult with their 10 year olds concerning computers and Internet.
