Ramifications in Copywrite law as per software?
This is a contract case between IBM and SCO Group (formerly Caldera), there are no Patent law implications here. This involves 2 companies that engaged in the development of a next generation Unix platform, 1 pulled out and the other (in desperate need for cash) sued in hopes of staying alive. In almost every case they have brought so far, they have lost becasue they cannot show any ownership of the applicable Copywrites. There are no "Patent" issues involved, no "Concepts and Methods" as per Unix (System 5) that are not heavily documented in any college Operating Systems text book (ask Andrew S. Tanenbaum, of Minix fame or the people at Bell Labs (Brian Kernighan would be one to speak with on this, he created Unix) or BSD.

I would suggest reading the actual court transcripts (they are available on line) and see what is actually at issue, as there are years ofdocumenation out there (and many pages to read). This is not a Patent case, this is a little company formerly known as Caldera trying to stay alive financially (they are only worth about $86 million).

I doubt that IBM stands to lose much, as SCO has failed to provide any evidence that would satusfy a judge (and the appeals have kicked it back when they have whined on anything).
