Why Not?
There are so many legitimate ones that it would only make sence to throw in and try to get something from them. And who said this case was frivilous the judge dismised it but said they can file for money lost during the 4 year period. now in a 4 year period I don't know how much microsoft made, I can assure it is a lot.
