If both US and British law had stuck with the original rules for establishing trademarks, neither Apple would have been issued a trademark, and the entire fight would have been avoided. Selecting a generic word that is "not generic to your industry" as your trademark is downright STUPID. The only thing that is more stupid is that we allow the law to be polluted by the nonsense that it ought to be legal.
