So, it we substitute "Dutch" (or Sweeden or any other country) for "US", the courts ought not to be able to enforce penalties on Lindows (US) or to attempt to fine Lindows (Dutch) for actions of the Lindows (US) corporation. Which of course is exactly the case that Lindows argued in their defense in the Dutch courts: They have changed their advertising to abide by the court order in the areas affected by the ruling. However, as the ruling does not apply in the area where the U.S. has jurisdiction, it is improper to fine the company for the behavior of the US division.
