Red Hat provides the source code to all of their patches under the GPL. You can download the source rpm for the RHEL kernel from ftp.redhat.com. They don't even require you to purchase RHEL to get the source for RHEL (which, according to the GPL they could do).

If (and I don't believe they do) they provide binary driver modules, this is *not* a GPL violation as the Linux kernel team allow binary kernel modules.

All of the source code Red Hat has produced is under the GPL or another open source license. You are completely wrong by saying otherwise.
