This is great news!
SCO's case is so filled with bad facts that they will poison the legal waters royally with this case and propel Linux and other free software products to heights otherwise unattainable. SCO is doing for Linux what Linux supporters could never imagine. They are giving Linux credibility and their case is so screwed up that the outcome will insure that Linux will be safe from further challenges into the forseeable future.

Under US Copyright law the copyright owner CONTROLS the software and can license it any way he sees fit. The GPL is just another license like Microsoft's EULA. A declaration that the GPL is invalid will also invalidate Microsoft's EULA and subject the whole software industry to a legal upheaval and a firestorm of litigation as the current longstanding order is overturned. And as one lawyer points out in the article, invalidating the GPL will subject SCO themselves to prosecution for mass copyright violations.

The end result is:

1) SCO loses and its the end of SCO. Countersuits and shareholder lawsuits abound.

or

2) SCO wins and its the end of SCO. Copyright and shareholder lawsuits abound.

Either way they lose, thats how desperate they are. They are committing corporate suicide while at the same time stroking money from the pockets of their shareholders.
