what do you mean - untested
you say the gpl license has never been tested.

maybe not directly - but certainly in kind.

the gpl says that if you change the code your changes become public as well.

that is the same thing as with the java programming language.

that is what got microsoft in trouble with sun.

microsoft made changes to the language that were windows specific and did not share that code with the public.

sun sued them and got a bunch of money.

but the changes were still never made public.

now microsoft is pushing a "new" language that looks and acts just like java.

is it java?
is microsoft still breaking the law?
will they ever stop trying to take control of everything that has to do with computers?
is sco just a microsoft flunky in wolfs clothing?

test it and see!
