Whose idea is not the only question...
According to law, it ought to be novell and non-trivial. I believe it also ought to be specific. And with all the other criticism of the patent office, this is where its current responsibilities are failing most. Is the Eolas patent non-trivial? I don't know. But it does strike me as overly broad.

There is also a separate question of timeliness in filing the claim against the infringer.
