Prior Art
The patent would be invalid if there was "prior art". Another person or company having the same idea before Eolas patented the technology.
HTML+ comes to mind right away, though that didn't take off.
Then there was also the Violas Browser.
While I'm all for patents, for driving innovation. It seems Eolas had a good idea that was already made and created, but they patented it anyway, not mentioning the "prior art". Also, if their patent was so sound, why did they wait until now to enforce it. Did they think we would forget the other ideas a decade later. A man put in an application for his son for a method of "swing legs to provide locomotion on a swing", and it went was patented (not that it's really a good patent). He did it to show that, not all patents filed are proper.
