Easy to be confused.
Prior to obtaining a clearer summary, here's what appears to be going on:

The EU is as you know, handing out patents for software as fast as they can. There are tens of thousands of software patents already.

(What the earlier EU legislation was intended to do was provide better definitions for software patents. The defeat of that legislation said prevented restrictions in law for all the software patents being issued.)

So, how are those patents to be treated?

Those opposed to patents wanted some kind of general policy.

What this statement says is that all the patents are valid, except for the ones successfully challenged in Court. That's a long, expensive process.

So the EU situation is fully receptive so software patents.

This is one of those odd situations in which an action means exactly the opposite of what it appears to mean at first glance.
