I agree with you that patents will hinder open source projects. They currently hinder closed source projects and so open source will be no exception.

When it comes to databases, customers who are switching don't seem to want the patented features the big guys offer. So I don't think these guys will need to get their products complex enough to step on patents.

But Wine hasn't been hindered so far. They went for the most commonly used APIs and recreated them for *nix systems to use. They have about 90% of the Win32 api already done. They state that they aren't working heavily on the rest because its not important. They are now (for a while) working on getting rid of all the bugs in the code written so far and making the libraries more reliable (still a long way to go).
