Symantec Suit - Possibly baseless
The code in question was originally written by Seagate for Windows at the express request of MS. They were paid in both $ and in kind (free use of MS offices and equipment) for doing so. Through various purchases and mergers the code wound up at Veritas. MS did buy (i.e. license) the technology a second time from Veritas for Windows 2000. I don't think that you get to take back a sale. Courts tend to frown on that kind of indian giving.

I very much doubt that Symantec wins this one. Especially since the Supreme Court several days ago unanimously barred automatic injunctive relief in patent cases.

Symantec has been a big part of the EU being tough on MS and is far from a disengenous injured party. They should have settled for a licensing agreement of some kind with MS. Only the lawyers are going to win this one.
