I agree with you, but for one thing.

Other sources indicate that lack of documentation is a "favoured method" for development at Microsoft. So, saying that putting documentation together is a "small thing" may (if what I heard is right) be not so small after all.

Besides, in my own experience and observation, trying to document something after you have done it isn't easy and takes a long time to get right.

Also, it is possible that this is why the EU are hammering them so hard. They know it's going to take a long time for Microsoft to become compliant.
