Well, if OEMs are free to set the default search engine, I have no problem.
It would only be the copies bought direct and installed by the end user that would default to Microsoft. Maybe technically illegal, but not a real big deal either.

And, if OEMs are getting more rights to set defaults, that is good. This way they can take money from Yahoo or Google to get their tool bars installed, and make Yahoo or Google the default search engine in all places.
