Grocery 'prefered customer' cards
Some applications that might fall under these laws are like these cards...annoying and intrusive but with a legitimate marketing purpose. Fortunately, they're are easy to opt out of by boycotting that company and some customers may not mind the intrusion in order to get a 'discount' on the companies products.

Spyware that is a real problem are those that take over a browser (usually IE), modify system settings such as the registry and hosts file, fight being uninstalled and do other nasty things. This is the kind of program that really needs to be targeted by such legistlation but it would be hard to separate them from more legitimate, but annoying, things.
