In the end it doesn't much matter because the courts will decide if SCO has a case or not. And I'm sure Microsoft is rather enjoying this if for no other reason than the chaos it is causing.
It's rather ironic that the same people who lived by the courts to try to nail Microsoft are now in pain because the courts have their nose under the tent again. Actually I rather hope SCO wins just to give those on the dark side (Linux) a taste of what it's like, and to reveal to the world that Linux is not as clean as it's proponents like to think.
