not easy to shut down a bank
Unlike the other 2 suits, they were seeking to shut down
areas of BoA that use Linux:

"impounding all Linux software products in the custody or
control of Defendant through the pendency of these
proceedings;"

But regardless if the suit has merit or not, any attempts to
shut down or impede the business of a major financial
institution would be met with major resistance. I'd doubt
that the federal government would even allow it.

Besides, BoA has more money to throw at lawyers.

As far as your other theory go, well the DaimlerChrysler
suite is pretty much done on a hunch (they basically got
sued because they didn't respond to a linux survey), so
they wouldn't need any more of a reason to sue BoA.
