Provided it goes to court.
Most suits like this are designed to intimidate a financially weaker opponent into submission. Many times, the entity filing the suit doesn't want it to get anywhere a jury or a judge who'll say "Cut the BS". They want to force the defendant to rack up hundreds of thousands of dollars in legal fees if they plan to take it this far. Most don't because of the huge cost and choose to settle for whatever amount the plantiff says.

Like the RIAA and BSA, SCO's shar...er...legal team is probably shopping around for a good, intimidatable, target to go after. Perhaps they found out that their 'A' list targets were willing to fight them and are searching for a new one.
