Here's an example of how stupid it is:
Lets say you own and apartment building and rent out 4 units. One day I come along and tell the world I own the apartment building and take you to court over it. I then send letters to each tenant saying they owe me rent.

Now the tenants have two choices:

one pay me the rent (this I would say is very stupid)

or wait until the court fight is over and pay the rent to the real owner.

Ether way I could not claim the past rent from the tenants prior to the end of the court battle. If anything I might be able to sue the old owner for the past rent but the tenants would be protected by law. Same thing goes for software. The current users of Linux could not be charged for past use of the software because they are protected by law. SCO can't charge fees because it hasn't proven they own anything yet. Once over if (and that's a huge if) they win the best the can do is start charging fees from that point on. I would also like to point out that any SCO owned code found in Linux will be removed and they will still not be able to charge fees for the new releases (assuming they ever find anything they own). SCO at that point might be able to sue for some damages from companies who released the old versions but the users will still be protected by law.
