You haven't a clue how DSL works. DSL does not go over over the same 'pair' of wires as the phone service. There are 4 wires in a phone cable and it uses 2 wires for one service. Ergo, you DON'T NEED phone service for DSL to 'work'.

A 'dial tone' is an analog sound. DSL is all digital and there is no 'dial tone'.
