Criminals are criminals reguardless of if they get caught
The people who broke into my wifes car to steal her Amp and Sub are criminals even though the police were never able catch them. I even knew exactly who they were too but couldn't prove. As it turns out a year later the twits burned down thier house and low and behold the fire inspector finds a room full of stolen car stereo equipement.

So basically if you are violating copyrights you are a criminal even if you don't get caught. Just as if you shoplift and don't get caught you are still a criminal. It doesn't take judge to label you that, the judge just implements the punishment. Criminals know who and what they are.
