A friend of my brother's had a shared folder of movies and music on PC that was 24/7 and he exceeded his monthly bandwith allocation. He ended up with a $400 internet bill for that month. Needless to say he doesn't have any content available for upload.

No law suit needed there. No law suit declaring P2P illegal either. If the RIAA really wanted to stop fileswapping they'd push for a law requiring ISPs to enforce bandwidth restrictions.
