As once the US courts get involved, I think the EU will have a problem.

The problem stems ( ibelieve if I've read this correctly in the past) from the point that even if the EU is wrong, and judgement reversed later on on appeal, the source code has already been distributed, whereas in the US, all things are on hold untill all appeals are exhusted.

The EU may be thinking just that, that at the very end they may be ruled against as overstepping their bounds, but by then the code will be all over the place, so the EU software companies get a leg up on their US counterparts, courtesy of the EU governmet..
