Follow the logics.
P1: Software patents are garbage.
P2: The USTPO recognises software patents.
P3: Eolas and UC have a valid software patent claim.
P1: Reiterating, software patents are garbage.
P4: Eolas actually makes stuff and doesn't just hold patents.
P1: Reiterating, software patents are garbage.
P5: MS is in violation of Eolas' patent claim in respect to IE.
P6: MS, acknowledging the violation as recognised by the USTPO, is making changes ti IE to end violation.
P1: reiterating, software patents are garbage.
Conclusion: There is no story here.
Now compare that to the NTP vs RIM case.
Premises P1 & P2 still hold but first, NTP has no valid patents in dispute with RIM and second, NTP doesn't actually make anything, they just purchase patents. Conclusion: Big Story!
The story in NTP vs RIM isn't that there is a patent dispute but the shabby condition of the USTPO and the highlights of the case that expose the stupidity of software patents.
In the MS vs Eolas case, no such highlights are blurting out to be seen. That does not justify software patents (as they are still garbage) nor does the premise of software patents being garbage negate the claims that Eolas has under the current law.
Until the USTPO ceases to recognise software patents, the MS vs Eolas case is no news. In spite of the USTPO recognition of software patents, the NTP vs RIM case is of great significants because it highlights the shortcommings of the USTPO in regards to granting patents without first reviewing them for validity; a problem probably due to their being overburdened and understaffed while simultaneously being pushed to respond rapidly to patent filings.
