I won't disagree with that -- lately, patent law has been grossly abused. However, Microsoft isn't the only one patenting everything it can. And I would disagree that Microsoft, because of its monopoly status, should be treated differently under patent law or copyright law. If others can patent IP, so should Microsoft. Besides, aren't people also arguing that copyright law has been abused recently, also? What else is a company to fall back on? Even the GPL depends on copyright.

You would have to explain that one to me -- I don't see how monopoly status would make any difference where patents are concerned. In fact, it appears (Eolas, etc.) that size has no bearing on successful patent enforcement.
