Unfortunately after this weeks events it could become a possibility, although very unlikely.

XML why patent something which can be "invented" within a month and take three years for the patent to be registered?

I am not saying that microsoft will fall back to sco-like strategies, but I think it's hard to disagree that microsoft archieved it's market share using fair business practices only.

Because of it's market share microsoft is in the position it can misuse patent law to lock out competitors. Regarding specific implementations on open standards, it would have been better to rely on copyright law instead. Since they decided for patent law it's clear the "specific" implementation is less specific than most people believe.
