Very difficult...
To understand what you are talking about. If Java were open source, how could anyone steal it from MS? It's already OPEN, as in FREELY AVAILABLE.

And what does any of this have to do with XML patents? I am no fan of these software patents either, but MS is one of many companies filing patent applications for various aspects of XML. So, you expect MS to stand on the sidelines while everyone else gobbles up the patents? MS didn't get to its lofty postion by being stupid.
