So basically they're a non-inventor entering an existing market and they're able to do that because there isn't a patent thicket blocking them.
Perhaps they should review their position on software patents in Europe, they grew large prior to 2000 without a single patent to their name and they can only enter new markets if they're not precluded by patents.
If SAP is precluded from hosted CRM in USA, then smaller European competitors can still sell hosted CRM solutions, even to USA, because hosted CRM doesn't require the company have a base in USA.
