Yes, Sun is only thinking about using GPL3, WHEN is is final. And, there
might be legal problems too. But, if the final GPL3 turns out to be even better than the current draft, and IF Sun decides to use it, that might help make up for some of the stupid things they said in the past, expecially if Linus continues to dig his heels in on GPL2.

And, the Solaris kernel is far superior to the Linux kernel (notice I am ONLY talking kernel), so, this could tilt things toward Solaris. In the end, I think that Linus will get over his tissy fit with Richard Stallman and will encourage developers to allow their code to be converted to GPL3.
