Linux can do what he wants with his code which he has licensed
v2. Either he'll agree to license it under v3, his code would have
to be rewritten, or his kernel contributions will stay at v2.

Why is v3 a "much better license"?

Look I'm happy Sun is looking at closer integration with Linux, it
has the technical resources to make a very positive contribution
and the software stack for a compelling Sun Linux distribution. I
also wish them well with OpenSolaris as it is a very good UNIX.
I'm simply confused why people are getting so worked up about
Linux kernel licensing when i) v3 doesn't exist, and v3 will not
improve the code of either.
