When presented to "12 good men" it could give the preception of not being quite "right" and as we know, perception is everything in most situations and especially in a jury trial.

You have to keep in mind that very few Joe Averages are going to really grasp the history of UNIX (heck I don't understand all of it.) and it's things like this that may swing their decision.

As I said, IBM seems to be doing just fine defending their position, granting this absolution dosen't look like it was needed and may cast a cloud over everything.
