The fact of the matter is the only thing patentable is an altogether new methodology. To take an existing methodology and create a software execution method would not be patentable due to the fact that it is obvious.

The spreedsheet wasn't obvious but to use it for a general ledger is. The maker of the spreedsheet --an altogether new methodology-- could have patented it but the maker of the first spreedsheet-based general ledger could not.

This is where the patent office gets all screwy. For example, someone creates and patents General Packet Radio Services (GPRS for sending data on the cellular network. Not obvious. Someone patents "Method for sending electronic mail to a small format portable computing device using the GPRS network." Very obvious! That is precisely what GPRS was invented for and yet, a company that has never produced any product in its life is suing a manufacturer of small format portable computing devices that use the GPRS network to send and receive electronic mail for infringing on their patent --a patent applied for long after such devices were already on the market!

How then can software writers and publishers protect their IP and revenue? The same way novel writers and publishers protect theirs; copyright.
