Don't see how that would work at all.
"Who said GPL the patented code? Mike said to allow GPL programmers to use the code royalty free, but charge when the program using the code was not GPLed."

That pretty much knocks out all the distro's and the major players (IBM, Sun, Etc.) doesn't it? It's either GPL'ed, or it's proprietary with little or no middle ground.

This of course assumes that open source comes up with something MS needs desperately and I don't see that happening. Open source is trying to be compatible with Windows/Office, MS doesn't care if it they are ever compatible with open source products. (In fact they don't want to be.)
