I know what to do. Not like this isn't done all the time anyway...
Open source companies have to make patents of their own, ones that MS would need. Like say apply for a patent to methods used to print "Hello world" using XML (you can't teach a programmer how to do anything without that, right?). That way they can use their patents as a bargaining chip with MS.

Novell would be the best company to do this, because they are the caretakers of Mono. So they would (or should) know best what MS would need. Apply for, and hopefully attain, patents that MS would need for Longhorn, and licence it so anybody using the GPL could use it, but nobody else. Unless of course, a company would be willing to let GPL programmers use some of their patents, then maybe exceptions could be made.
