You go to far. There is nothing "underhanded" about patenting your own work. (Well other than I think software patents are a very bad idea for everyone.)

It is completely unfair to tell a company or an individual to follow the rules and work within the system and then scold them for doing it. The fault is with the patent system, not every person or company that uses it.
