He does aknowledge that it is way too early, but he also voices out his disagreement with the whole treatment the DRM clause is being treated in the draft. Is sesnationalist comments that hurt the most, I'm even surprised this ZDNet article wasn't as much sensationlist as they have been in the past.

I think that a consensus will be reached sooner or later (the sooner, the better, though). And I tend to agree with Linus. His position really frees Linux, enabling it to be used in a DRMed environment or not. Linux + DRM doesn't necessarily mean the Linux kernel will get automatic DRM. I wonder, have you seen the posts concerning this on the LKML? Indeed Linus does not like DRM, but it so happens that Linux is gaining force in the embedded segment, where DRM will happen despite whatever our opinions are, and success or failure of such devices will only depend on the people who buy or not buy the products. In a sense, Linus is enabling such companies to be able to add DRM to the kernel, in the end the consumers have the last word about accepting that or not.

On the other hand, DRM in the kenrel does not mean you will have to run your computer with DRM turned on. True, some proprietary application may require you to have DRM enabled in your kernel, but then again, if you bought such application, you already knew about the situation. The system (the kernel) doesn't force you either. You are still free to CHOOSE whether you turn DRM on or not. That's the beauty of OSS.

How odd, under that perspective is, that Richard M. Stallman, is doing exactly what he so deeply rejects. If a softeware piece is to be really free, the one who uses it must be also free to secure it in some ways...

Sure DRM is evil, but if Linux is to continue to succeede in the embedded arena, it must be DRM friendly, which in my opinion is the pinacle of opennes, as it would remain open, accept DRM and you'll still be able to do what you please with the system.

Should Linus had more caution when wording his opinion? Yes, maybe. Will this be final? I can't tell. All scenarios should be thought through before puttin out a deffinite version, which is pretty much the general consensus at the moment.
