Can we say more fines at a level that will get the attention of MS shareholders?

You can, but Her Honor can't. She's constrained by the existing Consent Decree, which expires this year. The only provision it has for non-compliance is an extension of the same terms.

Since the DOJ and the Court have been happy with Microsoft so far, MS is going to get quite a bit of slack -- more, at least, than the EC gives them. The EC has so far given MS a year and a half of non-compliance and is only now even threatening, someday, to impose sanctions for non-compliance. Expect the US to be more forgiving.

Which means that barring a flagrant "and the horse you rode in on, too!" from MS to the Court they're home free with the Decree expiring before any kind of enforcement pressure reaches serious levels.
