Windows is a generic term that describes what the product is (a windowing gui). Calling the description of the box that holds a program view "a window" started long before MS co-opted it for its own name. It is more similar to Intel saying no one can use the word processer because it is part of Intel Pentium Processer.

As far as I know, an apple, or a red hat have nothing to do with computing, it's just a name, and therefore something you can obviously trademark. MS chose to use a generic term to describe what their product does as the name of their product. They have to live with the consequences, just like KDE (K Desktop Environment, don't ask me what the K stands for) has to put up with anyone using ZDE or XDE or whatever (I think CDE was first anyway). Since desktop environment is a generic term, describing function of the product.
