So what if the DOJ denies them, aquire anyway
If Oracle buys Peoplesoft, it would still not be close to being a monopoly. SAP still would hold a larger market share of the ERP business. How this deal can be seen as "Anticompetitive" is beyond me. You will still have SAP and that other 800 pound gorilla called Microsoft that will soon be "bundling" its ERP offerings with their Windows servers.
