There is a difference here
With Kazaa, I'm sure there is a EULA. In that EULA (though I do not use Kazaa and I have never read the EULA, but it just makes sense to have this a similar clause in the EULA) I would expect a clause that indicated that rights of the artists are the responsiblity of the user and not Kazaa's. If the work is copyrighted, it is the users responsiblity to take the appropriate actions. Kazaa cannot control how a program is being used. It can only protect itself.

With Linux and all open source, there is a EULA. And that EULA indicates that you are free to use the software. No where in the GNU dos it say that you have to pay so-and-so for something. It certainly doesn't say you have to ante up to SCO to use Linux. So unless SCO can legally add this addmendment, then ignorance has nothing to do with it. I read the only license that exists today. The license may change because of the case. But today it is the only legal document that I have.

SCO can send me all the letters they want to. I am not going to pay anything until they validate the letters and their claims. I am not doing anything illegal in my opinion because SCO has not explained why I am in violation. Only that they say that I am. At this stage, I feel these letters are nothing more than harrasment because no judge has ruled the legitmacy of SCO's claims.
