Ignorance and copyright

Please note that the RIAA case you mention was a matter of suit _filed_, not a court ruling. In the case of copyright, ignorance /is/ an excuse, since the unwitting infringer literally has no way to avoid the offense.

That's why the law only prescribes damages for willful infringement and requires that the copyright holder first notify the infringer and offer a reasonable opportunity to cure. When copyright is in dispute, as Professor Moglen points out, even the Court is unsure of the right of things. The rest of us are bound to await the Court's decision, and in the meantime there's no way to describe any infringement as "willful."
