Is this what the non-obvious test is for?
More than one person can have the same idea independantly and each has equal claim to the idea.

RIM didn't copy NTPs idea, they didn't read the patents or get inspiration from the 'thing' NTP made, because NTP don't make anything.

Isn't this the case that the 'non obvious to an expert in th field' test is supposed to fix? The case where the thing is obvious and hence repeadly invented independantly?
